3. Artisanal Nature of Creations
Tania Spagnolo Smart Couture creations are characterized by artisanal production and workmanship that can be done entirely or partially by hand.
For this reason, slight differences between products, small variations in workmanship, finishes, textures, or material rendering may represent a natural and distinctive characteristic of the artisanal product and do not necessarily constitute a lack of conformity.
4. Ready-to-Wear Products
Products indicated as ready-to-wear can be purchased in the sizes, colors, and characteristics shown on the respective product page.
The order is processed after payment confirmation.
Preparation and shipping times are indicative and may vary depending on the destination, peak periods, and any circumstances beyond the Seller's control.
5. Made to Order Products
Made to Order products are created after the order is received and confirmed.
Production may require different times compared to ready-to-wear products.

Any changes requested by the Customer compared to the standard model may lead to modifications in price and production times.
6. Personalized Products
Products created or modified based on specific customer requests are considered personalized.

- addition or removal of details;
- embroidery;
- initials, names, dates, or other writings;
- modifications to the original model;

Before production begins, the characteristics of the personalization, the timing, and the price can be agreed upon directly with the Customer.
7. Custom-Made Creations
The custom-made service involves the design and creation of a piece specifically for the Customer.
The process may include, depending on the project:
- initial meeting and consultation;
- measurement taking;
- definition of the Customer's needs;
- design of the creation;
- model study;
- research and selection of materials;
- proposal of fabrics and details;
- quotation elaboration;
- garment creation;
- any fittings and modifications necessary for proper fit.
Each custom-made project is unique and is managed according to the characteristics of the requested creation and the needs agreed upon with the Customer.
8. Quotes for Personalized and Custom-Made Creations
For personalized and custom-made projects, a specific quote may be prepared.
The quote may take into account:
- complexity of the design;
- type of garment;
- chosen fabrics and materials;
- quantity and complexity of workmanship;
- embroidery and applications;
- requested modifications;
- time required for creation.
The quote is valid for any period indicated therein.
After this period, the Seller reserves the right to update the price in relation to any changes in the costs of materials or workmanship.
9. Project Confirmation and Deposit
For personalized and custom-made creations, the start of the project may be subject to the payment of a deposit in the amount and manner communicated to the Customer.
Work begins after:
- approval of the project or quote;
- definition of the main characteristics of the creation;
- payment of the agreed deposit.
The deposit represents a mutual commitment between the Customer and Tania Spagnolo and allows for the initiation of design activities, material research, procurement, and production.
In case of subsequent withdrawal by the Customer, the conditions communicated in the quote or in the agreement relating to the specific project apply, in compliance with applicable law.
10. Prices
All prices are expressed in Euros.
Information regarding the application of VAT, taxes, and any additional costs is indicated during the purchase process, according to the tax regime applicable to the Seller.
For personalized products and custom-made creations, the price is defined based on the characteristics of the specific project.
11. Payment Methods
Available payment methods are indicated during the purchase process or communicated directly to the Customer in the case of personalized services and custom-made creations.
The Seller is not responsible for any service disruptions directly attributable to payment service providers.
12. Contract Conclusion
The presentation of products on the website does not automatically constitute a binding offer in cases provided for by law.
The order is considered received according to the methods indicated by the sales system used by the website.
The Customer is required to carefully check the data and information entered before confirming the order.
In case it is impossible to fulfill the order, the Customer will be informed, and any amounts already paid will be managed according to applicable law.
13. Product Availability

Given the artisanal, exclusive, and often limited nature of the creations, a temporary or definitive unavailability of a product or a specific material may occur.

Production times for Made to Order, personalized, and custom-made products depend on the characteristics of the specific project.
The times communicated to the Customer represent an estimate based on the complexity of the work and the availability of materials.
Any delays due to unpredictable circumstances or circumstances beyond the Seller's control will be communicated to the Customer.
15. Shipments and Deliveries
Products can be shipped to the destinations indicated during the purchase process.
Costs, methods, and estimated shipping times are indicated before the order is concluded, where applicable.
The Customer is responsible for the accuracy of the data provided for delivery.
Any delays attributable to the courier or circumstances beyond the Seller's control cannot be directly attributed to Tania Spagnolo, without prejudice to the rights recognized to the consumer by applicable law.
16. Right of Withdrawal for Non-Personalized Products
For products purchased remotely that have not been custom-made or clearly personalized, the consumer Customer may exercise the right of withdrawal within 14 days, in the cases and according to the methods provided by current legislation.
To communicate the intention to withdraw from the purchase, the Customer must send a communication to the contact details indicated in these Terms and Conditions of Sale.
The product must be returned in compliance with the conditions and timeframes provided by applicable law.
17. Return Conditions
The returned product must be intact and, to the extent reasonably necessary to verify its nature, characteristics, and functioning, must not have been used beyond such verification.
The Customer is invited to return the product with:
- any tags and accessories;
- original packaging, where present;
- documentation received with the product.
The return must take place according to the instructions communicated by the Seller.
Return costs are borne by the Customer, except in cases of defective, non-conforming product, or different legal provisions.
18. Exclusion of the Right of Withdrawal for Personalized and Custom-Made Products
Pursuant to applicable law, the right of withdrawal may be excluded for the supply of goods made to measure or clearly personalized.
Therefore, except for rights provided by law in case of defects or non-conformity, products made according to specific customer requests or clearly personalized cannot be returned for a simple change of mind.
This category includes, by way of example:
- custom-made creations;
- products modified in measurements;
- products made with fabrics or colors specifically chosen by the Customer;
- garments modified from the original model;
- products with personalized embroidery, initials, names, dates, or writings;
- creations made based on a specific project agreed with the Customer.
The exclusion of the right of withdrawal does not limit the consumer's rights in the presence of a defective product or one that does not conform to the contract.
19. Modifications Requested During Production
Any modifications requested by the Customer after project approval or the start of production will be evaluated based on the progress of the creation.
If the modifications are technically feasible, they may involve:
- price variations;
- additional costs;
- changes in delivery times;
- need to purchase new materials.
Such variations will be communicated to the Customer before proceeding, when possible.
20. Measurements Communicated Remotely
If the Customer independently provides their measurements without direct measurement by Tania Spagnolo, they are responsible for the correctness of the information transmitted.
The Seller undertakes to create the product based on the measurements and information received.
Any interventions made necessary by incorrect or incomplete measurements communicated by the Customer may involve additional costs and will be evaluated based on the technical possibility of modifying the garment.
21. Fittings for Custom-Made Garments
For some custom-made creations, one or more fittings may be necessary.
The number of fittings depends on the complexity of the project and the characteristics of the creation.
The Customer is required to collaborate in the creation process by attending agreed appointments or promptly providing the necessary information.
Any delays, absences, or variations requested by the Customer may affect the completion time of the garment.
22. Customer's Physical Changes
The fit of a custom-made garment depends on the measurements taken or communicated during the creation process.
Any significant changes in the Customer's measurements or physical conformation occurring after the measurements were taken or fittings may necessitate additional modifications.
Such interventions will be evaluated separately and may incur additional costs.
23. Fabrics and Materials
Tania Spagnolo selects fabrics and materials in relation to the characteristics of its creations.
In the case of fabrics in limited quantities, deadstock, end of roll, or non-reorderable materials, availability may be subject to variations.
If a chosen material becomes unavailable before production begins, the Customer will be offered any compatible alternatives for the project.
24. Defects and Legal Guarantee of Conformity
Products sold to consumers are subject to the legal guarantee of conformity provided by current legislation.
In case of a product that presents a defect or non-conformity, the Customer is invited to promptly contact the Seller, providing a description of the problem and any useful photographic documentation for evaluation.
The artisanal nature of a creation and the slight variations resulting therefrom do not automatically constitute a defect of conformity.
The rights recognized to the consumer by applicable law remain unaffected in any case.
25. Product Care and Maintenance
The Customer is invited to carefully follow the instructions regarding the care, washing, storage, and maintenance of the product.
The Seller cannot be held responsible for damages resulting from:
- improper use of the product;
- failure to comply with washing instructions;
- treatments not suitable for the fabric;
- interventions or modifications carried out by third parties;
- normal wear and tear of the product.
26. Gift Cards and Gift Vouchers
If available, Gift Cards and gift vouchers can be used according to the conditions indicated at the time of purchase.
